This Privacy Policy explains how FlyingMinds LLC, an Illinois limited liability
company ("FlyingMinds," "we," "us"), collects, uses, shares, and protects
information in connection with flyingminds.org and our related services (the
"Service"). It is part of, and incorporated into, our Terms of Service.
FlyingMinds is a learning service used by children in grades K–10 under the
direction of a parent or legal guardian. A parent or guardian creates and
controls the account, and is the person who agrees to this Policy and our Terms.
We are committed to protecting children's privacy and to complying with COPPA. This
section, and Section 4 ("Children's Privacy"), describe what we collect from
children, how a parent consents, and how a parent can review or delete their
child's information at any time. If you do not agree, please do not use the Service
or allow your child to use it.
1.1 Information you (the parent) give us. When you register, subscribe, or
contact us, we collect information such as the parent's name, email address, the
child's first name and grade level, an optional school/district, account login
credentials, your consent choices, and (for purchases) billing information. We do
not store full payment-card numbers — payments are processed by Stripe (see
Section 5).
1.2 Information from or about the child. To provide lessons, practice, and
progress tracking, we collect a limited amount of information about the child, such
as: first name and grade level; lesson and practice activity, answers, scores,
mastery, streaks, and time on task; and content the child enters into practice or
guided-practice features (including "Fred"). We collect only what is reasonably
necessary for the child to use the Service, and we do not require a child to
provide more personal information than is reasonably necessary to participate.
1.3 Information collected automatically. When the Service is used, we and our
service providers may collect device and usage information such as IP address,
browser/device type, pages viewed, referring/exit pages, and similar diagnostic
data, using cookies and similar technologies (see Section 6). On pages and
sessions used by children, we restrict automatic collection and third-party
trackers as described in Sections 4 and 6.
1.4 Categories that trigger heightened protection. Consistent with the COPPA
Rule, "personal information" includes identifiers such as name, contact
information, persistent identifiers (e.g., cookies, device IDs, IP address) used to
recognize a user over time, audio/photo/video of a child, precise geolocation,
and — where applicable — biometric and government-issued identifiers. We do not
collect biometric identifiers, government-ID numbers, precise geolocation, or
Social Security numbers from children, and we do not ask children for them.
We use information to: create and manage accounts; provide and personalize lessons,
practice, and progress tracking; process payments and subscriptions; communicate
with parents about the account and (where opted in) send reminders and progress
updates; provide customer support; maintain security and prevent fraud or abuse;
comply with law; and improve the Service. We do not use children's personal
information for behavioral/targeted advertising, and we do not allow our service
providers to use children's information for their own purposes.
For children under 13, we collect and use personal information only after obtaining
verifiable parental consent as required by COPPA, except for limited internal
operations the law permits (such as protecting the security or integrity of the
Service). For everyone, your use of the Service and your consent at sign-up form
the basis for the processing described here.
4.1 Parent is the account holder. A parent or guardian creates the account,
provides consent, and supervises the child's use.
4.2 Verifiable parental consent. Before we collect personal information from a
child under 13 (beyond what is permitted for internal operations), we obtain
verifiable parental consent using a method reasonably designed to confirm the
person consenting is the parent. [Describe the actual method you use — e.g., the
parent completing a paid subscription transaction that notifies the account holder,
a signed/scanned consent, knowledge-based verification, or another COPPA-approved
method. Confirm the chosen method with counsel.]
4.3 We collect only what's needed. We do not condition a child's participation
on providing more personal information than is reasonably necessary, and we limit
what we collect to operating the lessons, practice, and progress features.
4.4 No targeted advertising to children; separate consent for any third-party
sharing. We do not use children's personal information for behavioral or
targeted advertising. We do not disclose a child's personal information to third
parties for the third party's own purposes. If we ever propose to share a child's
personal information with a third party for any purpose beyond providing the Service
on our behalf, we will obtain separate verifiable parental consent first.
4.5 Parental rights. At any time, a parent may: (a) review the personal
information we have collected from their child; (b) request that we delete it;
and (c) refuse to permit further collection or use of the child's information.
To do any of these, contact support@flyingminds.org. Because some information is needed
to operate the Service, deleting it or refusing further collection may require us
to close the child's account.
4.6 Data minimization & retention. We keep a child's personal information only
as long as reasonably necessary to provide the Service and for the purposes
described in this Policy, and then delete it (see Section 7). We do not retain
children's personal information indefinitely.
4.7 Operator contact. The operator collecting and maintaining children's
personal information is FlyingMinds LLC (Illinois). Contact: [support
email].
We do not sell personal information, and we do not sell or share children's
personal information. We share information only as follows:
- Service providers ("processors") who help us run the Service and are
contractually limited to using the information only to provide services to us —
for example: Stripe (payment processing), Supabase (database, hosting,
and authentication), and [email/SMS/WhatsApp providers] (sending account and
opted-in notifications).
- Analytics and advertising on our public marketing pages only (see Section
6) — never to target advertising to children.
- Legal/safety: to comply with law, respond to lawful requests, enforce our
Terms, or protect the rights, safety, and security of our users, the public, or
FlyingMinds.
- Business transfers: in connection with a merger, acquisition, financing, or
sale of assets, subject to this Policy.
We use cookies and similar technologies for sign-in, security, preferences, and to
understand and improve the Service.
6.1 Advertising/analytics pixels (including the Meta Pixel). We may use
advertising and analytics technologies such as the Meta (Facebook) Pixel on our
public, non-child-directed marketing pages to measure and improve our marketing.
We do not run third-party advertising or behavioral-tracking pixels on pages or
logged-in sessions used by children, and we do not use children's information for
targeted advertising. [Operational requirement: ensure the Meta Pixel and any
similar third-party trackers are disabled on child-directed pages and on
authenticated child/parent learning sessions — see the engineering note.]
6.2 Your controls. You can manage cookies through your browser settings. Some
features may not work without certain cookies.
We retain personal information only as long as reasonably necessary for the purposes
described in this Policy — to operate the account and Service, comply with legal
obligations, resolve disputes, and enforce our agreements — and then delete or
de-identify it. For children's personal information, our practice is:
[describe retention timeframes — e.g., retained while the account is active and
for [X] days after cancellation/closure, then deleted, unless a longer period is
required by law]. A parent may request deletion sooner under Section 4.5.
We maintain reasonable administrative, technical, and physical safeguards designed
to protect personal information, including a written information security
program, access controls, encryption of data in transit and at rest where
appropriate, and vendor diligence. No method of transmission or storage is
completely secure, and we cannot guarantee absolute security. If a data breach
affecting your information occurs, we will notify you and applicable authorities as
required by law.
- Access/correction/deletion: Contact support@flyingminds.org to access, correct,
or delete account information (and, for children, see Section 4.5).
- Marketing communications: You may opt out of marketing emails using the
unsubscribe link; we may still send essential account/transactional messages.
- State privacy rights: Depending on your state, you may have additional rights
(such as to access, delete, correct, or opt out of certain processing). We honor
applicable state rights; contact support@flyingminds.org to exercise them. We do not
sell personal information or use it for cross-context behavioral advertising
involving children.
We send account and transactional messages (e.g., receipts, renewal and security
notices) regardless of marketing preferences, because they are needed to operate
the Service. Where you opt in, we may also send reminders, progress updates, and
similar messages by email, SMS, or WhatsApp; message and data rates may apply,
and you can opt out using the instructions in those messages.
The Service is intended for users in the United States. If you access it from
outside the U.S., you understand your information will be processed in the U.S. We
provide privacy rights as required by applicable U.S. state laws.
We may update this Policy. If we make material changes — and especially any change
to how we handle children's information that requires it — we will provide notice
and, where required by COPPA, obtain new parental consent before the change applies.
